Terms of Service
Effective date: November 25, 2025
These Terms of Service ("Terms") govern your access to and use of WeDevelopInPk's websites, mobile applications, services and content (collectively, the "Services") published by WeDevelopInPk ("we", "us", "our"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Definitions
- Services: our website (https://bitish.net/), mobile apps (DataVault, PixCrypt, Medical DICOM Viewer) and any related content or features.
- User Data: any files, images, DICOM files, credentials, or other information you upload or store using the Services.
2. Eligibility
By using the Services you represent that you are at least 13 years of age (or older if required by local law) and have legal capacity to enter contracts. If you use the Services on behalf of an organization, you represent you have authority to bind that organization.
3. Changes to Terms
We may update these Terms at any time. We will post the revised Terms at this location and update the "Effective date" above. Continued use after posting constitutes acceptance of the updated Terms.
4. License & Access
Subject to these Terms, WeDevelopInPk grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal or internal business purposes. We retain all rights not expressly granted to you.
5. User Responsibilities & Acceptable Use
You agree to:
- Use the Services lawfully and in compliance with all applicable laws and third-party terms.
- Not use the Services to infringe the rights of others, transmit malware, commit fraud, or engage in illegal activity.
- Keep your access credentials, passwords, and encryption keys secure.
6. Data, Privacy & Security
Our Privacy Policy describes how we collect and process personal data. In addition:
- WeDo NOT guarantee that any data will remain available forever — you are responsible for maintaining backups of all User Data you care about.
- Where the Services provide encryption functionality, you are responsible for your encryption passwords/keys. We do not retain or have access to plain-text keys unless explicitly stated; losing your key may render your encrypted data unrecoverable.
- If you choose to link cloud storage providers (e.g., Google Drive) or PACS servers, those third party services and their data handling are governed by the third party's policies — you should review them carefully.
7. Subscriptions, Payments & Refunds
If any paid features, subscriptions or "Pro" upgrades are offered through Google Play or other platforms, purchasing and refund policies are subject to that platform's rules (e.g., Google Play refund policy). We may also provide in-app purchases or licensing verification; all payments are final except as otherwise required by applicable law or by the payment provider.
8. Intellectual Property
All content, logos, text, designs, images, and code on the Services are owned or licensed by WeDevelopInPk. You may not copy, adapt, or redistribute our content without express written permission.
9. Third-Party Services
The Services may integrate or link to third-party services (cloud storage, analytics, ad networks, PACS, etc.). We are not responsible for third-party content, their privacy practices, or their uptime. Use of third-party integrations is at your own risk and subject to the third party's terms.
10. Warnings, Medical & Safety (DICOM Viewer)
Medical DICOM Viewer — Important safety notice:
- The Medical DICOM Viewer is a tool for viewing medical images. It is not a substitute for professional medical judgment.
- We do not provide diagnostic services. Relying solely on this app for clinical decisions is dangerous — always consult a qualified medical professional.
- If you use the app with Protected Health Information (PHI), you are responsible for ensuring compliance with relevant laws (e.g., HIPAA in the U.S.) and for obtaining necessary authorizations. We do not warrant that the Services are HIPAA-compliant unless we explicitly state so in writing.
- PACS, Drive, or server integrations: you must have lawful access to any remote systems you connect. We are not responsible for unauthorized access or for how the remote system handles or stores data.
- Always de-identify PHI when required by your policies and local laws.
11. App-Specific Terms
DataVault — Secure Vault
- Function: DataVault provides local encryption-based storage of photos, videos, and other files.
- Encryption & Keys: DataVault uses authenticated encryption (AES-256 / streaming AEAD for large files). You are responsible for your passwords/keys. If you lose your password or key, your data may be unrecoverable and WeDevelopInPk will not be liable for lost data.
- Original File Deletion: If you choose the option to delete source files from public storage after import, you confirm you have a backup or accept the permanent deletion risk.
- Pro features (e.g., cloud integration) may transmit files to third-party providers — review and consent to the provider's policies before use.
PixCrypt — Steganography & Hidden Storage
- Function: PixCrypt embeds encrypted payloads inside carrier images or videos (steganography).
- Lawful Use Only: You must not use PixCrypt to hide illegal content, to commit crimes, or to distribute copyrighted material without authorization.
- Key Responsibility: As with DataVault, if you lose the password/key used to encrypt hidden payloads, the hidden data cannot be recovered. You are solely responsible for key management.
- Carrier Files: The carrier file will remain a functional image/video in many cases, but we do not guarantee compatibility with all viewers or that carriers will remain unchanged after transmission or compression by social platforms.
- Malicious Use: We expressly prohibit using the app to hide malware, unauthorized access credentials, or to facilitate unlawful behavior. We may suspend accounts and cooperate with law enforcement if misuse is detected.
Medical DICOM Viewer — Clinical & Integration Notes
- Do not use for primary diagnosis unless you have proper clinical validation and approvals for your workflow.
- File Integrity: We attempt to preserve DICOM metadata and pixel data, however we do not guarantee correctness of any metadata tags nor the clinical suitability of processed images.
- PACS & Cloud Access: For features that allow connecting to PACS servers or cloud drives, you are responsible for credentials and lawful access; we do not store or forward credentials except for local encrypted caches required for app functionality (if applicable).
- Export & Sharing: If you share DICOM files, ensure you have removed or de-identified PHI when required.
12. Prohibited Conduct
Without limiting other provisions in these Terms, you may not:
- Use the Services to transmit, store, or access content that violates local law or third-party rights;
- Attempt to reverse-engineer the Services or bypass security;
- Use the Services to distribute malware, steal credentials, or assist unlawful activity;
- Misrepresent your identity or impersonate others when using the Services.
13. Moderation, Suspension & Termination
We reserve the right to suspend or terminate your access, remove content, or take technical steps (e.g., block accounts) to enforce these Terms or when required by law. We will not be liable for damages arising from such actions.
14. Warranty Disclaimer
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We disclaim all implied warranties, including fitness for a particular purpose, accuracy, or non-infringement.
15. Limitation of Liability
To the fullest extent permitted by law, WeDevelopInPk and its affiliates shall not be liable for indirect, incidental, special, consequential, punitive damages, lost profits, or loss of data arising from your use of the Services. Our total aggregate liability to you for any claim arising out of or relating to these Terms is limited to the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) USD $50.
16. Indemnification
You agree to indemnify, defend and hold harmless WeDevelopInPk from any third-party claims, liabilities, damages, losses or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your unauthorized or unlawful use of the Services.
17. Export & Compliance
You will comply with all applicable export and import laws. Some cryptographic features may be subject to export restrictions — you are responsible for compliance with those laws.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the jurisdiction where WeDevelopInPk is headquartered unless otherwise required by mandatory local law. Any dispute shall be resolved in a court of competent jurisdiction in that locale, unless the parties agree to arbitration.
19. DMCA & Copyright
If you believe content hosted on our Services infringes your copyright, notify us with sufficient detail to permit us to investigate (include a physical or electronic signature, identification of the copyrighted work, location of the infringing material, contact information, and a statement of good faith). We will respond as required by applicable law.
20. Changes to Services
We may modify, suspend, or discontinue the Services (or any part) at any time. We will attempt to provide notice of significant changes but are not required to do so.
